Practical Applications: Navigating California’s Latest Ban The Box Law
California’s latest Ban The Box Legislation makes significant changes to current workplace employee selection processes. This program will: 1) highlight the statute’s prohibitions against the use of an applicant’s criminal conviction history in making employee selection decisions prior to a conditional offer of employment; and 2) offer a unique perspective on the statutory requirement to “make an individualized assessment” of the applicant’s criminal history in relation to its impact on the specific job sought. Presented from the unique perspectives of an employment law and criminal defense attorney, this program will offer insight and practical applications for assessing the nature and gravity of prior offenses, considering the relevance of how much time has passed since the prior offense, and how these factors weigh against the nature of the job held or sought.
Participants will gain a practical understanding what constitutes a conviction and a dismissal under CA law. Attendees will also gain a deeper understanding of the statute, its overarching purpose, prohibitions and notification requirements, and will leave with a better understanding of how to operate within the new statutory scheme in order to provide a compliant and discrimination free workplace.
